EB-3 Green Card Attorney for Skilled Workers

The EB-3 green card for skilled workers is a permanent immigrant visa category for individuals with at least two years of job experience or training, and who are coming to the U.S. to perform work for which other qualified workers in the U.S. are not available. Skilled worker petitions are for those positions that may not require a Bachelor’s degree, but has duties that could not be discharged by an unskilled worker. A good example would be a skilled carpenter. In some cases, post-secondary education may also qualify as work experience.

Like all other Employment-based immigrant visa categories, those approved for EB-3 are eligible to apply for legal permanent resident status as are their spouse and minor children.

A Labor Certification (PERM) must be obtained by the petitioning employer to demonstrate that the immigrant will be performing work for which other workers in the U.S. were not available. A permanent, full-time job offer is also required. Wait times for an EB-3 visa may vary based on an individual’s country of origin, but frequently there is a years-long backlog for this visa category.
