PERM Labor Certification

Most individuals seeking lawful permanent residence (a “green card”) in the United States through employment must first be the beneficiary of their intended employer’s Labor Certification Application to the U.S. Department of Labor (DOL). Since 2005, the DOL has utilized an electronic attestation-based Labor Certification system called the Program Electronic Review Management (PERM) System.

A PERM Labor Certification Application is submitted to the DOL by one’s intended employer to attest that they have been unable to recruit a willing and qualified U.S. worker in the position. The DOL will approve the PERM Application if they are satisfied no such employees were in fact available for that position at the skill level and within geographic area for which the employer is seeking permanent resident status on the intended foreign employee’s behalf.
