ADJUSTMENT OF STATUS

Adjustment of Status or "AOS" is a process by which aliens in continuously lawful status progress directly from a temporary ("nonimmigrant") status to permanent resident status by applying through a USCIS office in the United States without leaving the country.  It is important to note that travel outside of the United States without advanced permission during the pendency of an AOS application automatically cancels the application, which in some cases prevents the alien from reentering the United States.

Two additional Applications should usually accompany each Adjustment Application:

1.  Form I-765, Application for Employment Authorization, and 

2.  Form I-131, Application for Advance Parole

This form should simultaneously accompany the Form I-485 for any applicant requesting employment authorization.

Form I-131, Application for Advance Parole

This form should simultaneously accompany the Form I-485 for any applicant requesting permission to travel outside of the United States during the pendency of their Adjustment Application
